			<content:encoded><![CDATA[<p>Kristen LaBrie, 38, of Salem, MA was found guilty of attempted murder and a number of other charges by a Lawrence Superior Court jury earlier this week for the death of her 9-year-old son in 2009.  </p>
<p>LaBrie was the former wife of <a href="http://www.tomkileylaw.com/blog/eric-fraser-dies-after-fatal-motorcycle-accident-in-malden/">Eric Fraser</a>, who was killed in a November 2009 <a href="http://www.tomkileylaw.com/practice-areas/motorcycle-accidents/">Massachusetts motorcycle accident</a>.</p>
<p><em>The Boston Globe</em> has reported that LaBrie intentionally withheld medications from her son, Jeremy Fraser, who was diagnosed with non-Hodgkin’s lymphoma in 2006 when he was 7.  </p>
<p>The medications could have treated and managed Jeremy’s lymphoma but without them, the lymphoma soon progressed into leukemia before doctors discovered what LaBrie had done.  LaBrie then lost custody of Jeremy, who went to live with his father, Eric.  Jeremy died in March of 2009.  </p>
<p>The jury deliberated for about 7 hours before returning the guilty verdict against LaBrie, who faces up to 40 years in prison at her sentencing hearing today. </p>

			<content:encoded><![CDATA[<p>Last week, an article came out with promising news that just might <a href="http://www.google.com/hostednews/ap/article/ALeqM5j4IM7c7jbVs5eSetjzlnEe4NvqUw?docId=1e2b17319ba14f8e9a554ccdc7ef6bfe">make the roadways a much safer place</a>. It has been announced that a research and development company, QinetiQ, of Waltham, Massachusetts, is currently working on equipment for cars that will be able to sense alcohol on the breath or through the skin of potential drunk drivers.  </p>
<p>This new technology has been dubbed the Driver Alcohol Detection Systems for Safety and it’s already in its beginning stages of development. The wait for DADSS may require some patience, as it could take 10 years until the sensors are ready to be installed in U.S. cars.  </p>
<p>U.S. Transportation Secretary Ray LaHood watched the technology in action at QinetiQ recently. A prototype was presented that analyzes whether or not an individual who gets behind the wheel has a blood alcohol concentration (BAC) of .08 or greater. If DADSS picks up a BAC at or more than the legal limit, the vehicle will not be able to start for the intoxicated driver. The BAC of a driver is set to be measured either by analyzing the person’s breath or through the skin, by means of sensors installed on the driving wheel and other locations.</p>
<p><img src="http://www.injuredbikerlaw.com/wp-content/uploads/2011/02/MADD.jpg" alt="MADD" title="MADD" width="89" height="108" class="alignleft size-full wp-image-2867" />The president of Mothers Against Drunk Driving (MADD), Laura Dean Mooney, is enthusiastic about the proposed technology and hopes that preventing a vehicle from starting will realistically translate to lives that are saved.  Mooney stated that she hopes to see DADSS become as commonly known as anti-lock braking systems or air bags that are in the cars we drive now.  </p>
<p>Motorcycles were involved in nearly 4,595 fatal crashes <a href="http://www-fars.nhtsa.dot.gov/Vehicles/VehiclesAllVehicles.aspx">across the country in 2009</a>, accounting for just over 10% of the total number of deadly accidents in the U.S. that year. This new technology could pave the way to take drunk driving off the road for good and protect drivers and riders everywhere. Let’s hope it does just that.</p>

			<content:encoded><![CDATA[<p><strong><a href="http://www.boston.com/news/local/breaking_news/2010/10/mass_bikers_to.html" target="_blank">Some good news surfaced last month for Massachusetts motorcyclists</a></strong> when a number of insurance companies were found to have significantly overcharged bikers for coverage. </p>
<p>In the article, Attorney General Martha Coakley stated that a settlement of $12.1 million will be distributed among motorcyclists from five insurance companies in the state after her office investigated and found evidence of intentionally overestimated premiums.  These companies had driven up premiums for motorcyclists with “inflated and un-depreciated motorcycle values.”</p>
<p>Earlier in 2010, other settlements were reached with additional insurance companies for their covered motorcyclists, bringing the total of recovered money to consumers to nearly $39 million, with about $1.5 million headed back to the Commonwealth.</p>
<p>It was reported that Coakley stated the investigation began with one motorcyclist’s complaint and the investigation revealed many, many more.</p>

		<description><![CDATA[Robert Blais was allegedly driving drunk when he had a motorcycle accident near Routes 101 and 114 in Bedford, NH.]]></description>
			<content:encoded><![CDATA[<p><em> </em>Last Thursday, 27-year-old motorcyclist Robert Blais was <strong><a href="http://www.nashuatelegraph.com/news/887235-196/man-injured-after-motorcycle-crash-in-bedford.html" target="_blank">allegedly driving drunk when he crashed</a></strong> near Routes 101 and 114 in Bedford, NH. </p>
<p>Blais, of Manchester, had driven off the road and, luckily, another driver noticed his motorcycle lights on in the wooded area and called police a little after 2:00am.</p>
<p>Police responded to the scene and discovered that Blais had sustained several serious injuries as a result of being thrown off of his motorcycle.  It was reported that Blais did have his helmet on.  Emergency responders transported Blais to a local hospital and then by air to Massachusetts General Hospital for treatment. </p>
<p>Police are continuing to investigate the crash.</p>

<p><a href="http://www.enterprisenews.com/topstories/x482009326/Governor-signs-Ryan-s-Bill-into-law" target="_blank">Mass. Governor Deval Patrick has signed the new legislation</a> also known as &#8220;<span style="color: #800000;"><strong>Ryan&#8217;s Bill</strong></span>&#8221; in honor of Ryan Orcutt, a 16-year-old Brockton teen who died in a motorcycle crash last year. The new legislation was backed by the <strong><a href="http://www.massmotorcycle.org/content.aspx?page_id=3&amp;club_id=769540" target="_blank">Massachusetts Motorcycle Association</a></strong>.</p>
<p><img class="alignleft size-full wp-image-2340" title="Mass Rider Education Program" src="http://www.injuredbikerlaw.com/wp-content/uploads/2010/08/MassRiderEducationProgram.jpg" alt="Mass Rider Education Program" width="127" height="118" />The motorcycle association cited statistics from the <a href="http://www.mass.gov/rmv/motorcycle/index.htm" target="_blank">Motorcycle Rider Education Program</a>, saying that 63% of motorcycle fatalities in the last 10 years involved motorcyclists who had not taken safety courses. About 23% of the motorcycle fatalities were riders under 21.</p>
<p>Under the new bill, young riders applying for the Junior Operator license will need to pass a vision and a written test, as well as take a safety course at the 15 spots across Massachusetts with certified instructors.</p>

			<content:encoded><![CDATA[<p>The <a href="http://cpsc.gov/" target="_blank">US Consumer Product Safety Commission (CPSC)</a> recently announced on its website that <a href="http://www.kawasaki.com/" target="_blank">Kawasaki Motors Corp. USA</a> recalls about 4,000 off-road Kawasaki 2010 motorcycles due to <strong>injury hazards</strong>.</p>
<p>The exact name of the recalled motorcycles is <strong>Kawasaki 2010 KLX110 Off-Road Motorcycles</strong>. This involves KLX110CAF and KLX110DAF off-road motorcycles (<em>sold in green</em>).</p>

<p>The motorocycles are recalled since a faulty housing for the ignition switch can allow water to enter and activate the electric starter unintentionally. No injuries have been reported, yet, but the faulty switch poses a serious hazard of injury or death.</p>
<p>The motorcycles, manufactured in Thailand, were sold at Kawasaki dealerships nationwide from August 2009 through February 2010 for about $2,100.</p>

<p>Harley-Davidson&#8217;s corporate headquearters will remain in Wisconsin &#8211; a fact that doesn&#8217;t bring much consolation to their employees and Milwakee community, which have seen other corporations leave the state. For example, two years ago the beer giant <a href="http://www.millerbrewing.com" target="_blank">Miller Brewing Co</a>. moved its headquarters to Chicago in after merging with <a href="http://www.molsoncoors.com" target="_blank">Molson Coors Brewing Co</a>.</p>
<p>After <a href="http://www.schlitzgusto.com/" target="_blank">Schlitz</a>, known as &#8220;<em>the beer that made Milwaukee famous</em>&#8221; got sold to a Detroit company in the 1980s due to financial and labor problems, Harley-Davidson was left as Milwakee&#8217;s only world-famous signature brand bringing tourists and motorcycle lovers to the city.</p>
<p>This may soon change.</p>
<p>The company currently employs 1,630 motorcycle manufacturing employees in Wisconsin.</p>
<p>According to Tom Steepy, a lifelong Harley rider and director of the suburban Milwaukee chapter of the <a href="http://www.harley-davidson.com/wcm/Content/Pages/HOG/HOG.jsp" target="_blank">Harley Owners Group (HOG)</a>, &#8220;If they moved their manufacturing, it would just create a void you can&#8217;t fill.&#8221;</p>
<p>&#8221; They&#8217;ve just become the blood of the community,&#8221; he said.</p>

			<content:encoded><![CDATA[<p>We recently blogged about the <a href="http://www.injuredbikerlaw.com/man-killed-in-bridgton-motorcycle-crash/" target="_self">Bridgton motorcycle accident</a> in which a man was killed and a woman injured due to his &#8220;trick riding.&#8221;</p>
<p>In a few words, on Monday, Aug 2, a group of four motorcyclists after paying a visit to the Trailside Steak and Seafood Restaurant were travelling on Route 302 in Maine. <a href="http://www.patriotledger.com/topstories/x312166384/Quincy-man-killed-in-Maine-motorcycle-accident" target="_blank">One of the bikers</a>, a Quincy man stood up on his <strong><a href="http://www.motorcycle.com/specs/harley-davidson/cruiser/2004/softail-reg/night-train.html" target="_blank">2004 Harley-Davidson Night Train</a></strong> motorcycle and started waving with one hand, while holding the bike&#8217;s handlebar with the other hand, going at 55 mph.</p>
<p>He then lost control and fell, sustaining fatal injuries. The victim, <strong>Justin Dilks</strong>, 34, landed in the middle of the road.</p>
<p>Hi friend and fellow biker, <strong>Marjorie Loonie</strong>, 45, of Melrose trying to avoid crashing into him, swerved and lost control of her own <strong>2006 Harley-Davidson</strong> motorcycle and also crashed. Loonie suffered serious injury and was airlifted to Central Maine Medical Center where she is listed in a stable condition.</p>
<p>Neither Dilks, nor Loonie, nor any of the other bikers in the group were wearing helmets, which could have perhaps save them from head injury and trauma. Dilks was pronounced dead at the scene from severe head injuries, police said.</p>

<p>According to the police, the trick riding led to the fatal crash. Trick riding is dangerous and usually rare. We are sorry that a fellow motorcyclist got killed while engaging in this behavior, and that his friend got injured. It serves as a valuable and obvious lesson to other riders not to rush to do something which may put them and other people in the path of injury and death.</p>
<p>Many factors lead to the death of Justin Dilks and the injury of Marjorie Loonie, but we can narrow them down to the most obvious three:</p>
<p><strong><span style="color: #800000;">1.</span></strong> None were wearing helmets.</p>
<p><strong>Motorcycle helmets are essential safety gear</strong> which should we worn at all times. It saves bikers from severe head trauma and brain injury, and some models even prevent facial injuries. Even though helmet use is not required in every state, bikers&#8217; common sense should tell me to put one on before hitting the road.</p>
<p><strong><span style="color: #800000;">2.</span></strong> Dilks was riding while standing on his bike.</p>
<p>Even if he was doing it in on a parked motorcycle, instead of going at 55 mph, it just seems as a very irresponsible behavior &#8211; an accident waiting to happen. And it did. The sad part is that it ended terribly, both for Dilks and Loonie.</p>
<p><strong><span style="color: #800000;">3.</span></strong> The stretch of US Route 302 where the crash occurred is known as a busy and <strong>a frequent crash site</strong>, so the motorcyclists should have been extra careful when travelling on it.</p>
<p>If you are riding on notorious, or unfamiliar roads, always stay alert and focused, epsecially at night.</p>

<p>Justin Dilks is remembered by friends as a kind man who lived life to the fullest, and his loss is felt by many. He was on vacation at the Keoka Beach Campground in Waterford, just north of Bridgton, police said.</p>

This will also be the GNR only US show for all of 2010.</p>
