Insurers to Refund Massachusetts Motorcycle Owners

The Insurance Journal reported last week that nearly 14,150 Massachusetts motorcyclists who were overcharged for their insurance coverage will be reimbursed by their insurance carriers later this month after a settlement was reached last week by Attorney General Martha Coakley’s office.

The latest insurance companies who quoted and sold inflated motorcycle premiums to their customers are Travelers Insurance, Fireman’s Fund, and Electric Insurance. The total settlement was reportedly $5.6 million among the three insurance companies. The three insurance carriers are expected to send out the refund checks to the overcharged customers by the end of October.

The settlement from last week will result in an average refund check of $400, with the refund amounts to motorcycle owners ranging anywhere from $100 to just over $1,000. According to the Attorney General, the investigation into insurance carriers overcharging motorcycle owners began with just one customer complaint about his premium.

In 2010, the Attorney General reached settlements with 12 other insurance carriers who were found to also have overcharged Massachusetts motorcyclists. The settlements last year resulted in reimbursements totaling roughly $40 million.

NH Motorcyclist Injured in Single Vehicle Accident in Manchester

Mark Manuel, 25, of Allenstown, NH was seriously injured this past Saturday morning when he lost control of the motorcycle he was riding and veered off of the roadway at the Amoskeag rotary in Manchester, NH.

Manuel was riding westbound on Amoskeag Street around 1:30 a.m. when he left the roadway and crashed his bike into the curbing of the traffic island within the rotary. Emergency responders found him in the island and rushed him to a local hospital for severe facial and head injuries. Manuel was then taken to a Boston area hospital for further medical treatment.

The Examiner reports that both alcohol and speed have been named as contributing factors in the serious crash and police have charged Manuel with operating under the influence of liquor (OUIL). Officials are continuing to investigate the motorcycle accident.

The National Highway Traffic Safety Administration (NHTSA) estimates that approximately 1/3 of all motorcycle accident fatalities involve motorcyclists who have blood alcohol concentrations (BACs) of .08 or more. Thankfully, there were no fatalities involved in this serious crash.

The NHTSA strongly encourages all riders to make other arrangements whenever alcohol is involved, such as finding a designated driver or using public transportation, and to leave the bike at home.

Motorcyclist Killed After Hitting a Tree in Shrewsbury

Eric Weir, 28, of Worcester died last Saturday evening after he struck a tree while riding his motorcycle on Baker Avenue in Shrewsbury.

According to The Worcester Telegram & Gazette, Weir was riding north just after 8:30 that evening when he reportedly left the roadway and crashed into the tree. He was rushed to an area hospital for treatment, but succumbed to his injuries a short time later.

Authorities have reported that no other vehicles were involved in the tragic motorcycle crash. Baker Avenue was shut down to traffic for nearly two hours while authorities reconstructed the scene. Officials are continuing their investigation into the fatal collision and have not yet determined the exact cause of the motorcycle accident.

More Than 100 Motorcyclists Ride To Commemorate Fallen Vets and 9/11 Victims

The Enterprise News reported that over 100 motorcyclists took part in a South Shore ride this past Sunday to commemorate the victims of the September 11, 2001 attacks and to raise funds for the Wounded Warrior Project, which offers help to veterans who have been injured in both the Afghanistan and Iraq wars.

The bikers rode about 50 miles along the South Shore, through Marshfield, and ended the ride in Abington at the VFW. There was a BBQ following the ride for the bikers, friends, and family. The event brought in roughly $2,000 total to benefit the Wounded Warrior Project.

Tom Morrison, who is an Army veteran and the senior commander with the VFW Post 5737 in Abington, set up the ride with the help of Navy veteran Brian Martin, who was a previous post commander at the VFW.

Gloucester Biker Dies After Being Thrown Off Bike
Dana Martin, 28, of Gloucester was killed last week in a deadly motorcycle crash after being ejected off of his motorcycle on Route 1 in Danvers near the Route 114 exit.

The Gloucester Times reports that Martin was riding along the busy roadway around 7:00pm last Monday evening and had been weaving in and out of traffic when he somehow lost control of his bike, hit the guardrail in the median, and was thrown from the bike.

Martin’s motorcycle continued forward about 70 feet before stopping in the highway’s northbound lanes. Emergency workers rushed Martin to an area hospital for emergency treatment, but he was pronounced dead some time later.

Massachusetts State Police had shut down the northbound lanes of Route 1 for over an hour following the accident in order to reconstruct the scene. The deadly crash remains under investigation.

16-Year-Old Dies in Lawrence Motorcycle Crash
Luis Lara, 16, of Lawrence died in a fatal motorcycle accident last Tuesday evening after reportedly losing control of his Suzuki motorcycle on Canal Street in Lawrence and hitting a tree near the intersection of Amesbury Street.

The Eagle Tribune reports that witnesses saw Lara speeding and doing wheelies on his motorcycle just prior to him losing control and crashing into the tree around 9:00pm that night.

Authorities who responded to the scene found Lara on the ground with a serious head injury. It was reported that Lara’s helmet had a large crack on it from the collision. Lara was transported to an area hospital, where he was later pronounced dead. Police continue to investigate this tragic crash.

Windsor Motorcyclist Injured in Collision with Moose
Donald Allard, 55, of Windsor was seriously injured after he crashed into a moose while on his motorcycle in Cheshire last Wednesday. Allard was on his Harley Davidson FLT134 heading east on Route 9 just after 4:30pm when he collided with the moose head-on, causing his bike to skid roughly 130 feet on the roadway.

Allard fell off of his bike after it came to a rest and was taken to a local hospital for treatment of his serious injuries. The Environmental Police responded to the scene to euthanize the moose, due to its injuries from the impact.

Motorcyclist Injured in Derry Van Crash
Paul Mileski, 60, suffered serious injuries in motorcycle collision last Thursday afternoon around 3:00pm when he and a van crashed into one another in Derry, NH where Maple Street and Ash Street Extension meet.

The Eagle Tribune reports that Mileski was transported to an area hospital before being transferred to a Boston area hospital for further treatment of his injuries from the accident. Derry police are continuing their investigation into the collision. The identification of the driver of the van was not released.

Pickup Truck Driver Charged in Fatal Motorcycle Crash

Matthew Denice, 23, was killed last Friday evening after he was struck on his motorcycle and then dragged about one quarter of a mile by a drunk driver who ran a stop sign in Milford.

The Boston Globe reports that Denice was hit at the intersection of Congress Street and Fayette Street just before 8:00pm by a pickup truck operated by Nicolas Guaman, 34, who is here illegally from Ecuador. Guaman’s 4-year-old child was a passenger in the truck at the time of the deadly crash.

After Guaman struck Denice, he continued to drive forward despite Denice’s screaming from under the pickup. Several witnesses who saw the horrible collision had rushed towards the pickup and made attempts to stop Guaman.

Guaman drove until the corner of where West Street and Bancroft Avenue meet, where his pickup left the road and went onto a yard. Denice landed on the sidewalk in front of the yard, where emergency responders found him and rushed him to a local hospital, where he was pronounced dead.

Guaman reportedly backed his truck up after driving onto the lawn and continued driving 2 blocks down the road before police caught up with him and arrested him.

According to the Globe article, Guaman appeared in Milford District Court yesterday to answer to numerous charges against him stemming from the deadly motorcycle accident. U.S. Immigration and Customs Enforcement (ICE) have been notified and will determine deportation details following Guaman’s trial for his role in the fatal accident. Guaman was being held on $25,000 bail.

Chelsea Motorcyclist Killed on Route 1

Cory White, 40, of Chelsea was killed in a motorcycle crash on the evening of August 3 in Chelsea and officials are continuing to investigate the exact cause of White’s tragic death.

According to The Chelsea Record, White was operating his Triumph motorcycle northbound on Route 1 that night around 7:00pm, when the bike somehow rode off a raised portion of the roadway and fell roughly 30 feet onto Sixth Street below.

White was declared dead at the fatal crash site by first responders. Police continue to ask anyone who may have seen the accident to contact them.

The Centers for Disease Control and Prevention (CDC) have reported that in between 2001 and 2008 more than 34,000 motorcyclists were killed in collisions in the U.S.
